About D. Brett Turnbull

Brett Turnbull has embraced a philosophy that keeps clients first, an approach that has distinguished him as a leading trial lawyer. He is nationally recognized for obtaining top-dollar jury verdicts and settlements on behalf of accident victims killed or injured by the negligent and wrongful actions of others. When Brett goes before a jury, he is focused on achieving one goal: getting justice for his clients. He accomplishes this by providing evidence for their accident claims and guiding the jury toward awarding a fair and reasonable verdict.

Brett has more than a decade of successful courtroom experience in complex litigation, including trucking cases, product liability, automobile defects, pediatric burns, traumatic brain injury, and nursing home malpractice. Brett is licensed in four states and has taken 70 jury trials to verdict. In the last few years alone, Brett has received jury verdicts of $21.5 million, including $9 million in product liability cases and $5 million in medical malpractice cases.

Beyond the verdicts, Brett takes great pride in helping others. “The thing that I enjoy most about my job is that I get to take up the part of the underdog and stand up for those who have been wronged,” he says. “There is more to this job than just money, and that feels good.”

The Case That Defined His Career

“There have been a series of cases that, as I look back, defined my career and are benchmarks in my practice history.

First, there was a case about five years into my practice where a little boy was brain damaged from mercury. He found thermostats next to the dumpster at the apartment he lived in, cracked the glass, and played with the mercury like a toy. He had a devastating brain injury as a result. The apartment complex denied putting the thermostats there. We were able to find a witness, now living four hours away, who had been the maintenance man at the time of the incident at the apartment complex. He admitted he cleaned out the shed and put the thermostats there. The case settled, and the little boy was able to be medically taken care of for the rest of his life.

Next, we had a case where a client was working at a recycling plant with waste from power companies. His job was to disassemble large metal components. When he struck an arrestor, it was under pressure, exploded, and severely injured him. We had a difficult time determining who had sent the arrestor to the recycling plant without evacuating the gas that placed the component under pressure. We hired electrical experts and used photogrammetry to identify the shipper of this product and recovered a significant settlement to take care of our client for the rest of his life.

Then, in 2017, I had a trial in Los Angeles against a car manufacturer after a man’s wife and two small children were killed in a car crash. The car that hit them had a brake defect that the jury agreed caused the crash. The trial lasted six weeks, and we obtained a total of $24.9 million from the jury for all of the Plaintiffs.

Last, I had a trial in 2019 in Auburn, AL, where a college student was misdiagnosed by an urgent care clinic and tragically died of a pulmonary embolism. Her parents and I went to trial, and the jury returned a verdict of $9 million against the negligent medical providers. This was a record verdict in that county.”

A Leader in the Legal Field

Respect for the justice system and a desire to help others led Brett, a graduate of the University of Alabama, to pursue legal studies at Cumberland School of Law. There he discovered his true passion: trial law. As a class leader, Brett won national recognition for his trial advocacy skills. That leadership track continued throughout Brett’s legal career. Today, he gives back to his profession by serving in leadership positions with the Alabama Association for Justice, Alabama State Bar, American Association for Justice, and Southern Trial Lawyers Association.

In addition to his successful law practice, Brett is a founding member and instructor of Trial Structure and co-founder of the National Brain Injury Lawyer organization. He has been featured on Courtroom View Network, named a Super Lawyer for almost a decade running, listed in the Top 40 Under 40, and is regarded as one of the top up-and-coming trial lawyers in the United States.
